Felony Resentencing: Understanding DOC’s Role in Release Planning

In the past 3 years, there have been several major developments in the law leading to a significant number of individuals going back to court for a felony resentencing hearings, stemming from both recent legislative changes and significant Washington Supreme Court decisions.

In this CLE, defenders will hear about the current legal landscape of resentencing cases and how building a solid release plan is necessary for any client who may be eligible for immediate release or release in the near future.  To present a solid release plan, defense attorneys and team members must understand and may include what the DOC will do to plan for an individual’s release. DOC resources are significant, and include access to DOC funded housing, as well as individual case support navigating various systems. To competently represent a client on a resentencing matter, defense attorneys must understand the resources and coordinate with DOC to plan for a client’s transition and successful reentry.  Staff from the DOC will present an overview of the DOC’s role, procedures and available resources for individuals at release.
