ICWA at Removal
This is the first of a three-part webinar series on the Indian Child Welfare Act (ICWA).  The goal of the webinar is to help Washington practitioners understand the relationship between the federal ICWA provisions (the statute, regulations, and guidelines) and state statutes (RCW 13.34, 13.38).  The first session will focus on removal and ICWA issues that arise at or before a 72 hour shelter care hearing.  The presenters will discuss how courts in Washington should determine when ICWA applies, what procedures the court should follow to make that determination, and how the legal standard for removal changes when ICWA applies.  Because there are many difference sources of law, both state and federal, the presenters will explain how family defense attorneys can decide what law to rely on when attempting to prevent removal.
