Navigating the Complexity of Defending Sex Offenses: Evaluations and Negotiations
Preparing a client for a sexual behavior evaluation and risk assessment can determine whether that evaluation will help your client, particularly in negotiations. Topics covered in an evaluation will be explained thoroughly, emphasizing the importance of the attorney’s knowledge of what to expect from the evaluation prior to seeking one. Excerpts from reports prepared by evaluators will be reviewed and analyzed for the importance and application in defending a sex offense case. Attorneys will be provided with process and strategy for what to discuss with a client and/or the evaluator prior to the client participating in the evaluation process. A sample sexual history polygraph will be reviewed for usefulness and application to negotiations. Attorneys will learn how to address the potential of previously unreported victims. Attorneys will learn the strategy behind whether or not, and the circumstances under which defense would want to share the evaluation with the State, both for the current case and for any future use.
