Opposing Delayed Competency Evaluations and Restoration
Presented by attorney Kari Reardon, this webinar will discuss tools for fighting delayed competency evaluations and restorations, including motions to sanction Western State and Eastern State Hospitals, motions arguing the presence of outpatient restoration programs in less than a quarter of Washington counties violates equal protection and the privileges and immunities clause of the Washington Constitution. Motions for dismissal related to due process violations pursuant to State v. Hand, 192 Wn.2d 289, 429 P.3d 502 (2018) will be discussed. The training will provide an overview of 2022 legislation about competency proceedings and give defenders guidance on using the legislative changes to benefit their clients.
