This training is intended for both criminal attorneys and investigators. In this CLE, Thurston County Public Defender Kevin Griffin will provide an overview of the use of affirmative defenses in criminal cases. Mr. Griffin will discuss the affirmative defenses, what makes a defense an “affirmative defense,” how an affirmative defense differs from one that negates an element of the crime and what to look for when investigating an affirmative defense. This CLE will also cover litigating an affirmative defense, including notice requirements, the burden to establish an affirmative defense, and seeking and getting the jury instruction.
