A.B. by and through Trueblood et. al. v Washington State DSHS, No. 15–35462 (often referred to simply as
Trueblood) is a class action lawsuit that enforces a person’s constitutional right to timely competency evaluation and restoration services.
Trueblood class members are all people waiting in jail for court-ordered competency evaluation and restoration services. The
Trueblood litigation has resulted in the creation of a variety of unique services and diversion programs for current and former
Trueblood class members. The most prominent
Trueblood programs include: the Forensic Navigator Program; Outpatient Competency Restoration Program (OCRP); Forensic Housing and Recovery through Peer Services (FHARPS); and Forensic Projects for Assistance in Transitions from Homelessness (FPATH). These programs can provide transitional housing, permanent supportive housing, case management, transportation, benefits management, and other wraparound services. The “Trueblood Diversion Programs and Changes from SB 5440” CLE is designed to increase awareness about the many
Trueblood programs and educate attorneys on how to navigate the programs. This CLE will also address the changes made to the law through SB 5440, including new pathways to dismissal and diversion of criminal charges alleged to have been committed by
Trueblood class members.
