Update on Harassment and Overview of Other Low-Level Charges with High-Level Consequences
Description: An introduction to the basics of crimmigration for new defenders and a refresher for everyone else, this presentation will cover what a defense attorney needs to do whenever they have a client who is not a U.S. citizen and why they need to do it. This will include a brief review of the cases setting out counsel’s duty towards their noncitizen clients and a description of the services and resources offered by WDA’s Immigration Project and how to access them.

We will then discuss the important new decision from the Ninth Circuit, Rodriguez-Hernandez v. Garland, 89 F.3d 742 (9th Cir. 2023), which drastically changes the immigration consequences triggered by misdemeanor and felony harassment convictions. And finally, we will review the immigration consequences of some of the more common charges, including DV-VNCO, assault, and DUI. There will be time for questions at the end.
