State v. Pettis WL387267 (unpublished)
State v. Pettis is an unpublished case because it deals with a well settled area of law. Despite this, defense at times misses filing the appropriate pretrial motion to exclude lay and expert opinions which directly suggest guilt. Justice Fearing dissented, but if you read his first paragraph, he agrees with the majority that the opinion testimony provided by the police officer/investigator did violate the right to a fair trial by invading the province of the jury. However, Justice Fearing believes the majority did not consider all of the relevant testimony, which affects whether or not the error is harmless as well.
