Case Description:
John Douglas Mayfield was convicted of a crime and sentenced to prison based on evidence obtained in what the State concedes was an illegal seizure and a violation of his right to privacy. The Court of Appeals declined to hear Mayfield’s state constitutional argument for the suppression of this illegally obtained evidence because of the way his legal brief was structured. Instead, it affirmed his conviction and held that the receipt of a Ferrier warning automatically cured the prior Fourth Amendment violation.
